NAMING LAW

How to register a baby’s name in India

The birth register can carry a name from day one, or receive it later. What the law and the rules say, and where states differ.

What to prepare

  • The hospital or institution report of the birth, or the details a head of household gives within 21 days. [1]
  • The birth certificate or registration number, when you are adding a name later. [1]
  • Parents’ identity documents; Aadhaar numbers are asked for where available. [2]
  • In some states, a notarised affidavit and a school certificate for a late name entry. [8]
  • The late fee that your state’s rules set, if you are past the free period. [7] [8]

The law behind the register

Births in India are registered under the Registration of Births and Deaths Act, 1969. States make their own rules under the Act, so fees, forms and even the office you visit can differ from one state to the next. The Registrar General of India publishes model rules from 1999 that many state rules follow. [1] [7]

Reporting the birth

Under the model rules, a birth is to be reported within 21 days. The 2023 amendment widened the list of people who give the information to include adoptive parents, a single parent or unwed mother, and the biological parent in a surrogacy, and it asks for the parents’ Aadhaar numbers where available. The Registrar must give the informant a birth certificate free of charge within seven days of completing the registration. [1] [2]

You can register a birth before you have a name

Section 14 of the Act allows a birth to be registered without a name. The parent or guardian then gives the name to the Registrar within the prescribed period, orally or in writing, and the Registrar enters it. Many families use this route to keep the naming ceremony and the paperwork on their own timetable. [3] [1]

Adding the name later: the time limits

Under model rule 10, the name is entered free of charge if it is given within 12 months of the registration. After 12 months, and up to 15 years from the registration, the Registrar enters it on payment of a late fee, which was Rs 5 in the model rules. The 12 months run from the date of registration, not the date of birth, and you present the birth certificate with the request. The 15-year limit is a model-rule figure; Greater Chennai Corporation, for example, says it relaxed the limit until 31 December 2024. [1] [8]

Late registration of the birth itself

Registering the birth late has its own tiers. In the model rules, a report after 21 days but within 30 days carries a small late fee, one between 30 days and a year needs the written permission of the prescribed officer, and one after a year needs a magistrate’s order. The 2023 amendment keeps the same shape, with the District Registrar for the one-year tier and the District Magistrate, Sub-Divisional Magistrate or authorised Executive Magistrate beyond it. The 2026 amendment adds a further step: after two years the order must come from a Judicial Magistrate of the First Class, and the AIR report says it comes into force on 1 October 2026. [1] [2] [5] [6]

Fees and procedure differ by state

Goa’s 2024 rules set late fees of Rs 20, Rs 50 and Rs 100 for the three tiers. Greater Chennai Corporation lists Rs 100, Rs 200 and Rs 500, and asks for a notarised affidavit and school certificate when a name is added between 12 months and 15 years. Delhi’s corporation runs the process online, with an Add Name action on the citizen dashboard once the certificate is generated. Chandigarh handles name addition at its counters. Check the office or portal that holds your child’s record before you pay or print anything. [7] [8] [9] [10]

Why the name on the certificate matters

For a person born on or after 1 October 2023, the birth certificate is the single proof of date and place of birth for school admission, a driving licence, the voter list, marriage registration, government posts, a passport and Aadhaar. Once a name is entered, the Act itself has no provision to change it, and Greater Chennai Corporation states that a registered name cannot be changed. Spend the time on the spelling before you submit it. [2] [3] [8]

Frequently asked questions

Can I register a birth without a name?

Yes. Section 14 of the 1969 Act lets the Registrar register the birth and take the name later from the parent or guardian. [3]

How long do I have to add the name free of charge?

Twelve months from the date of registration under model rule 10. Tamil Nadu’s corporation also describes the declaration as free within that period. [1] [8]

What if I miss the 21-day reporting window?

You pay a late fee or need an official’s permission or a magistrate’s order, depending on how late. Goa’s rules, for example, set Rs 20, Rs 50 and Rs 100 for three tiers. [7]

Does the first birth certificate cost money?

The Act as amended requires the Registrar to give the informant the certificate free of charge within seven days of completing registration. Extra copies and searches can carry fees, which Goa lists as Rs 50 and Rs 20. [2] [7]

What changed in 2026?

The 2026 amendment adds a Judicial Magistrate of the First Class order for registration delayed beyond two years. AIR reported that it comes into force on 1 October 2026. [5] [6]
